These Terms and Conditions (“Terms”) apply to all services provided by Wicked Gardens Ltd (“the Company”) registered in England and Wales under company number 14102011, with its registered office at 4 Armoury Road, London, England, SE8 4LA. By engaging the services of Wicked Gardens Ltd, you agree to be bound by these Terms.

1. Deposits and Payments 1.1. A 50% deposit of the total project cost is required upon acceptance of the quote and prior to commencement of any work. 1.2. The remaining balance is payable upon completion of the project, unless otherwise agreed in writing. 1.3. Payments can be made via bank transfer or other methods as specified by the Company. 1.4. All payments must be made in GBP unless otherwise agreed.

2. Cancellations and Refunds 2.1. If you cancel a project prior to its commencement, the Company will retain the deposit as a cancellation fee. 2.2. If a project is cancelled after commencement, you will be liable for the total project fee to cover material and labour costs already incurred, as well as compensation for lost business. 2.3. In the event of cancellation, the client will be charged the full labour cost incurred up to the date of cancellation. 2.4. The Company reserves the right to charge the full project price if the client attempts to hire contractors engaged by the Company to complete the project without the Company’s consent. Such actions will be considered a breach of these Terms and Conditions. 2.5. Cancellation requests must be submitted in writing to the Company’s registered office or via email.

3. Project Timelines 3.1. The Company will make every reasonable effort to complete the project within the agreed timeframe. However, timelines may be subject to change due to weather conditions, unforeseen circumstances, or delays beyond the Company’s control. 3.2. The Company will communicate any changes to the timeline as soon as possible.

4. Materials and Supplies 4.1. All materials and supplies required for the project will be procured by the Company unless otherwise agreed in writing. 4.2. Any materials ordered specifically for the project cannot be returned or refunded.

5. Client Responsibilities 5.1. You are responsible for ensuring access to the project site during agreed working hours. 5.2. You must inform the Company of any underground utilities, structures, or hazards on the project site prior to the commencement of work. 5.3. The Company will not be held liable for damages to unknown underground utilities or structures not disclosed by the client.

6. Liability 6.1. The Company carries Public Liability Insurance and will take all reasonable care during the project. However, the Company is not liable for any damages caused by circumstances beyond its control. 6.2. The Company’s liability for any claim arising from the services provided is limited to the amount of fees paid by you for the specific project.

7. Warranties 7.1. The Company provides a 12-month warranty on workmanship. Any defects arising within this period will be rectified at no additional cost. 7.2. The warranty does not cover damage caused by improper maintenance, misuse, or external factors beyond the Company’s control.

8. Force Majeure 8.1. The Company will not be liable for any delays or failure to perform its obligations under these Terms due to events beyond its reasonable control, including but not limited to acts of God, adverse weather conditions, strikes, or supply chain disruptions.

9. Data Protection 9.1. The Company complies with the General Data Protection Regulation (GDPR) and will only use your personal data for the purposes of delivering the services agreed upon. 9.2. Your personal data will not be shared with third parties without your explicit consent, except where required by law.

10. Governing Law 10.1. These Terms are governed by the laws of England and Wales. 10.2. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Amendments 11.1. The Company reserves the right to amend these Terms from time to time. Any changes will be communicated to you in writing.

12. Acceptance 12.1. By engaging the services of Wicked Gardens Ltd, you acknowledge that you have read, understood, and agree to be bound by these Terms.
